All content, features, and functionality on the services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software, are the exclusive property of Pliersjaw or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the services for your personal or internal business purposes. This license does not include any resale or commercial use of the services or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the services or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

All rights not expressly granted herein are reserved by Pliersjaw. Any unauthorized use of the services or its contents will terminate the permission or license granted by Pliersjaw.

6. User-Generated Content

Users may have the opportunity to submit, post, or otherwise transmit content through the services ("User-Generated Content"). By submitting User-Generated Content, you grant Pliersjaw a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or control all rights to the User-Generated Content you submit and that the content is accurate, not confidential, and does not violate any contractual restrictions or third-party rights. Pliersjaw takes no responsibility and assumes no liability for any User-Generated Content submitted by you or any other user.

We reserve the right to remove or edit any User-Generated Content for any reason, including but not limited to violations of these Terms of Service or applicable laws.

7. Payment Terms

Access to certain features of the services may require payment of fees. You agree to pay all fees associated with your use of the services in accordance with the pricing plan you select. All fees are non-refundable unless otherwise stated in writing by Pliersjaw.

Payment must be made using a valid payment method as specified during the registration process. You authorize Pliersjaw to charge your chosen payment method for the total amount due. If your payment method fails or is declined, we reserve the right to suspend or terminate your access to the services until payment is received.

We may change our fees and payment terms from time to time, and we will provide notice of any changes through the services or via email. Your continued use of the services after any changes to the fees constitutes your acceptance of the new payment terms.

8. Service Modifications

Pliersjaw reserves the right to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. You agree that Pliersjaw will not be liable to you or to any third party for any modification, suspension, or discontinuance of the services.

We may also impose limits on certain features and services or restrict your access to parts or all of the services without notice or liability. Any new features or tools that are added to the current services shall also be subject to these Terms of Service.

It is your responsibility to review these Terms of Service periodically for updates. Your continued use of the services after any changes constitutes your acceptance of the new terms.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Pliersjaw, its affiliates, licensors, or service providers, or their respective officers, directors, employees, agents, contractors, successors, or assigns be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your access to or use of, or inability to access or use, the services.

In no event shall Pliersjaw’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such jurisdictions, Pliersjaw’s liability is limited to the maximum extent permitted by law.

10. Termination

These Terms of Service are effective until terminated by either you or Pliersjaw. You may terminate these Terms of Service at any time by discontinuing your use of the services and deleting your account. Pliersjaw may terminate these Terms of Service at any time, without notice, for any reason, including but not limited to your breach of these Terms of Service.

Upon termination, your right to use the services will immediately cease. All provisions of these Terms of Service which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Termination of your account does not relieve you of any obligation to pay any outstanding fees or charges incurred prior to termination.
